Thug jailed
THREE teenage attackers who went to Trinity Beach looking for a fight must pay the consequences for their thuggish behaviour, a Cairns judge said yesterday.
Nicholas Adam Burns, 18, was sentenced to six months' jail for affray and assault causing bodily harm in January 2007 and a violent assault on a Yorkeys Knob couple just two months later.
He will serve six weeks before being released on parole.
Two other attackers, Kara Temese Murray and Miles Albert Burns, both aged 18, narrowly escaped jail and instead received two years’ probation for affray and two assaults causing bodily harm.
Crown prosecutor Derek Kordick told the court the Yorkeys Knob trio caught a taxi to Trinity Beach on January 13 after receiving a phone call about a fight planned for that night.
Phone communication had been used to recruit a large number of youths for the fight.
Mr Kordick said police dispersed a crowd of youths from the skate park around 9pm.
An hour later, the trio set upon a group of nine young people on Nathan St.
Outside court, the three victims of the January 13 attack, who asked not to be named, had mixed feelings about the
sentences.
One victim, who was just 16 when Murray hit her in the head with a glass bottle, said she had hoped to see her attacker go to jail.
Judge Sarah Bradley delayed yesterday's sentence for three hours, warning that all three were likely to be going to jail and their parents should be in court.
When Cairns District Court resumed just after 3pm, the mothers of both Burns boys were present, along with Murray's aunt.
Mr Kordick said Nicholas and Miles Burns had repeatedly punched and kicked an 18-year-old male to the head.
When the boy's 16-year-old girlfriend tried to intervene, Miles Burns punched her in the face and Murray struck her with a glass bottle.
Murray also hit a second 16-year-old girl in the back of the head with a bottle.
As the girl ran to call for help, Murray swung the bottle again but missed.
Two months after the brawl, Nicholas Burns violently assaulted a Yorkeys Knob couple.
Nicholas Burns will be eligible for parole on March 16.
