Palmerville murder accused bail decision will be handed down tomorrow
JUSTICE Jim Henry will make a decision tomorrow morning in the bail application of a couple accused of killing a gold prospector on their Cape York property.
Stephen Struber, 55, and wife Dianne Wilson Struber, 50, are charged with murdering Mareeba man Bruce Schuler on July 9, this year.
Their application for bail began before Cairns Supreme Court Justice Jim Henry this morning.
Mr Struber's defence barrister, Peter Davis SC, said the three eyewitnesses police rely on have alleged they heard shots fired near Mr Schuler as he was prospecting at Palmerville Station and have not seen him since.
''There is no real evidence to corroborate that version,'' Mr Davis said.
''And there are some very mysterious aspects of the evidence of the three surviving men.''
Mr Davis told the court the men had convictions for drug offences and did not make a complaint to police until eight hours after Mr Schuler had allegedly been shot.
The application resumes this afternoon, when the Crown is expected to outline its objection to bail.
